Appeals court sides with Trump administration in Khalil deportation case

Politico reports that a federal appeals court today handed the Trump administration a victory in its efforts to deport pro-Palestinian activist Mahmoud Khalil.

A three-judge panel of the U.S. Court of Appeals for the Third Circuit Court of Appeals held that Khalil must pursue his case through the immigration court system and raised the possibility that he could be re-detained.

“The scheme Congress enacted governing immigration proceedings provides Khalil a meaningful forum in which to raise his claims later on — in a petition for review of a final order of removal,” said the decision.

Until this point, Khalil’s effort to fight deportation has proceeded in immigration court, where he has fared poorly, and in federal court, where he secured release from detention.

"The 3rd Circuit panel consisted of Judge Thomas Hardiman, appointed by then-President George W. Bush; Judge Stephanos Bibas, appointed by President Donald Trump; and Judge Arianna Freeman, appointed by then- President Joe Biden. Freeman wrote a partial dissent, disagreeing that the matter should proceed through immigration court."
