ICYMI: 2025 Performance Metrics Ask Even More of IJs than 2017 Metrics

I'm teaching removal procedure today in immigration law. In updating my materials I came across this September 12, 2025 memo from EOIR regarding IJ performance metrics. I was on this path to find out if the 2017 performance metrics had been reinstated under Trump 2.0. They have not. The new performance metrics are harsher. For reals.

Here are just a few comparators:

  • 2017: 85% of all non-status detained removal cases should be completed within 60 days of NTA
    • 2025: 95% of all non-status detained removal cases should be completed within 60 days of NTA
  • 2017: 85% of all motions should be adjudicated within 40 days of filing
    • 2025: 95% of all motions should be adjudicated within 30 days of filing
  • 2017: 90% of custody redeterminations should be completed within 14 days of the request for redetermination
    • 2025: 95% of custody redeterminations should be completed within 5 days of the request for determination
