New Attorney General Opinion Issued Today in Matter of Negusie

Today the Attorney General issued a decision in Matter of Negusie, 29 I&N Dec. 285 (A.G. 2025). The Attorney General vacated the Board’s March 16, 2021 order
in the case, allowing the 2020 opinion by Attorney General Barr opinion, 28 I. & N. Dec. 120 (A.G. 2020), to retake effect.

Under the new ruling, if an immigration judge finds a noncitizen participated in the persecution of another as defined by the INA, 8 U.S.C. §§ 1158(b)(2)(A)(i), 1231(b)(3)(B)(i), the noncitizen cannot present evidence of coercion or duress to obtain eligibility for asylum or withholding of removal.

More background on the duress exception is found here, courtesy of the Immigration Policy Tracking Project.
