No in-state tuition for Kansas’ undocumented students

Courthouse News Service: The Trump administration continues its efforts to challenge state laws allowing undocumented immigrants to pay resident fees at state colleges and universities. A federal court granted the U.S. government and Kansas’s consent judgment holding a state law is preempted by federal law "because it gives in-state tuition to some unlawfully present aliens based on Kansas high school attendance without making the same benefit available to out-of-state U.S. citizens. Motions to intervene are denied as futile and the governor’s motion to dismiss as moot."
