The Trump administration’s goal of mass detention and deportation has given new meaning to the word “voluntary” in the voluntary departure context. What the U.S. Supreme Court has coined as a “quid pro quo” between the government and a noncitizen with benefits of avoiding a removal order and extended detention has become a mechanism of coercion and prolonged detention. During this webinar, the faculty will discuss the statutory and regulatory authority for voluntary departure, how voluntary departure is being misused by both Immigration Judges and Immigration and Customs Enforcement, and how practitioners can best protect their clients. The faculty will also discuss the relevance of voluntary departure to habeas petitions.
