Description
This national webinar is designed for judges, court staff, judicial educators and family lawyers and will report on custody case law trends through 2026, addressing issues that arise in custody cases involving immigrant survivors of domestic violence and their children. Faculty will discuss the relevance in custody cases of the dynamics of domestic violence in mixed immigration status families, coercive control, and the re-validated (2025) danger assessment for immigrants. The presentation will cover topics such as the range of legal immigration options for battered immigrants and abused children and evidence-based research on how applying for immigration relief improves victims’ and their children’s safety and access to justice. Common misconceptions about the extent to which immigration status impacts custody decision-making will be addressed. Faculty will discuss best practices in custody cases for judges and family lawyers when immigration status becomes an issue in protection order, divorce and custody actions.
